Trypp is a Software-as-a-Service (SaaS) platform provided by Trypp Inc. that offers real-time UX metrics and AI-driven usability insights to help UX and product teams improve their digital products. The Service includes, but is not limited to, data collection, analytics, reporting tools, and AI-powered recommendations.
3. User Accounts
- Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify Trypp immediately of any unauthorized use.
- Account Responsibility: You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations.
4. Payment and Subscription
- Subscription Plans: Trypp offers various subscription plans. By subscribing, you agree to pay the fees associated with your chosen plan.
- Billing: Fees are billed in advance on a recurring basis (e.g., monthly or annually). You authorize Trypp to charge your provided payment method automatically.
- Cancellation and Refunds: You may cancel your subscription at any time, but refunds are not provided for partial subscription periods.
- Price Changes: Trypp reserves the right to modify subscription fees. We will notify you in advance of any changes, and continued use after such changes constitutes acceptance.
5. Intellectual Property
- Trypp’s Ownership: Trypp retains all rights, title, and interest in the Service, including its software, platform, content, and materials.
- Your Data: You retain ownership of the data you provide to Trypp (e.g., user interaction data). By using the Service, you grant Trypp a worldwide, non-exclusive license to use, process, and analyze your data solely to provide and improve the Service.
- Aggregated Data: Trypp may use aggregated or anonymized data derived from your use for research, analytics, or to enhance the Service, provided it does not identify you or your users.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to Trypp’s systems or networks.

7. Termination

- By You: You may terminate your account at any time by following the instructions on the Service.
- Effect of Termination: Upon termination, your right to use the Service will cease immediately. Trypp may delete your data after a reasonable period, subject to legal obligations.
8. Disclaimers and Limitations of Liability
- “As Is” Service: Trypp provides the Service “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- No Guarantee: Trypp does not guarantee that the Service will be uninterrupted, error-free, or completely secure.
- Limitation of Liability: To the fullest extent permitted by law, Trypp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
- Cap on Liability: Trypp’s total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to Trypp in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Trypp, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or connected to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
10. Data Protection

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in San Francisco, California.
12. Dispute Resolution
- Arbitration: Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in San Francisco, California.
- Class Action Waiver: You agree to resolve any disputes on an individual basis and waive the right to participate in a class action or consolidated proceeding.
13. Changes to Terms
Trypp reserves the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and, where appropriate, via email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
14. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trypp regarding the Service.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- No Waiver: Trypp’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
